To celebrate the impending launch of the Expert Witness Institute’s presence in Singapore, the Expert Witness Institute is pleased to present its inaugural seminar in Singapore on “The Role of an Expert in Dispute Resolution”.

In the disputes world, experts who give evidence in court and in arbitration are frequently necessary. More importantly, however, is perhaps the question of whether experts help the process or are they simply adding to the cost of dispute resolution. This seminar, under the auspices of the soon-to-be launched Singapore Branch of the Expert Witness Institute UK, seeks to start the conversation amongst Experts primarily based in Singapore. Experts will speak and assess their own role as it were. They will be joined by lawyers who, of course, regularly interact or deal with Experts. The Expert Witness Institute is privileged to have The Honourable Justice Quentin Loh of the Supreme Court of Singapore as its Guest of Honour and Keynote Speaker. Participants will have the opportunity to hear firsthand, Justice Loh’s views on Experts. Justice Loh is of course no stranger to experts or their evidence, having dealt with experts as a lawyer, arbitrator and judge. This seminar provides an excellent opportunity for experts and others, to join the conversation on the role of Experts in Singapore.

About the Keynote Speaker & Guest-of Honour

The Honourable Justice Quentin Loh – Judge of the Supreme Court of Singapore Quentin Loh was appointed a Judicial Commissioner of the Supreme Court of Singapore on 1 September 2009 and a Supreme Court Judge on 1 June 2010. He is also Judge in-charge of the Singapore International Commercial Court. Prior to his joining the Bench, he was the Deputy Managing Partner of Rajah & Tann LLP from December 2003 to 12 August 2009. He was a key member of its international arbitration group as well as head of the Construction & Projects and Insurance and Reinsurance practice groups. Prior to joining Rajah & Tann in 2001 as a member of its Executive Committee, he was Managing Partner of Cooma, Lau & Loh, a firm he co-founded in 1978. He was appointed Senior Counsel in 1999. Until his appointment as a Judicial Commissioner, he was also a founding director of Maxwell Chambers, a dedicated building for holding arbitrations. In private practice, he has appeared as counsel in numerous domestic and international arbitrations, (SIAC and non-SIAC, ad hoc arbitrations, ICC, HKIAC) in various jurisdictions. His areas of practice also included liability insurance, professional negligence claims, D&O claims, regulatory aspects of insurance, reinsurance, building and construction claims, public law, shipping and admiralty, shipbuilding and rig construction claims and a wide range of commercial and corporate litigation.

Sir Martin Spencer is a Justice of the High Court, Queen's Bench Division. Previously, he was a leading clinical negligence barrister, whose practice at Hailsham Chambers involved all aspects of clinical negligence, with particular expertise in complex high quantum claims, representing both claimants and defendants. Significant cases include Chester v Afshar [2005] 1 AC 134. House of Lords, a leading case on causation and the duty to warn in clinical negligence, and Daniels v Walker [2000] 1 WLR 1382 Court of Appeal, on the use of joint experts under the CPR. Sir Martin was called to the Bar in 1979 and took silk in 2003. He was appointed as a Recorder in 2001 and authorised to sit as a Deputy High Court Judge in 2017. As chair of the EWI, Sir Martin is focused on ensuring the Institute continues to lead in supporting experts from all professional disciplines, raising standards through training and education and representing their views across a wide range of stakeholders.
Sir Martin has a law degree and MA (jurisprudence) from Oxford University, and studied as a Danish Government Scholar in Copenhagen. He has delivered numerous lectures and contributed to a number of publications in the UK and Denmark.

Sir Vivian Ramsey qualified as a civil engineer before joining the English Bar in 1981, becoming a QC in 1992. He was head of Keating Chambers before being appointed a High Court judge in 2005 where he was judge in charge of the Technology and Construction Court from 2007 to 2010. He was also heavily involved in the implementation of the Jackson Reforms which included a review of the costs of expert evidence. Following his retirement in 2014 he was appointed as an International Judge in the Singapore International Commercial Court and acts as an arbitrator, mediator, expert and dispute board member around the world. He is a Visiting Professor at King's College, London and edits Keating on Construction Contracts, now in its tenth edition. He has had a long standing involvement with EWI and was appointed as President of Expert Witness Institute Singapore in 2018.

About the Organising Chairman

Prof Leslie Chew SC is the Dean of the School of Law at the Singapore University of Social Sciences.  He graduated from law school in the then University of Singapore (now NUS) in 1978 and is an Advocate and Solicitor of the Supreme Court of Singapore. He is also a Solicitor of England & Wales. He was appointed a Senior Counsel by the Supreme Court of Singapore in 2000 and continues to practice as a Consultant at Withers KhattarWong, primarily at the Commercial Bar. He began his professional career in the Singapore Legal Service and was a Deputy Public Prosecutor and State Counsel with the Ministry of Defence. He was a lawyer in KhattarWong (now Withers KhattarWong, Singapore) for 20 years and was a joint Managing Partner from 1999 to 2006.  In 2007, he was appointed a District Judge.  He subsequently held office as a Senior District Judge overseeing the Civil Justice Division of the State Courts (then the Subordinate Courts) until he retired from the Singapore Legal Service in March of 2014.  Upon retiring from the Singapore Legal Service, he returned to private practice, re-joining his previous firm of KhattarWong LLP. In the course of his career as a lawyer of almost 40 years’ experience both in private practice and public service, Leslie has had a wide practice covering most areas of commercial law including international arbitration.  He is a past President and a Fellow of the Singapore Institute of Arbitrators. He is also a Fellow of the Chartered Institute of Arbitrators.

About the Plenary Speakers

Mr. Chan Leng Sun SC is an independent counsel and arbitrator with Essex Court Chambers Duxton (Singapore Group Practice). He is a Senior Counsel of the Supreme Court of Singapore and is also qualified in Malaysia and England. Leng Sun has a broad commercial practice that covers maritime law, international trade and company law. Leng Sun is the Deputy Chairman of the Singapore International Arbitration Centre (SIAC) and a member of the ICC Commission on Arbitration and ADR. He is the Deputy Chairman of the SGX (Singapore Exchange) Appeals Committee and the Immediate Past President of the Singapore Institute of Arbitrators. He was formerly Baker & McKenzie’s Global Head of Arbitration. Leng Sun is recognized among the top lawyers worldwide by "Legal 500 Asia Pacific 2018", "Who's Who Legal - Litigation 2017" and, "Who's Who Legal - Arbitration 2017". He is described by Chambers Asia-Pacific 2017 as "one of the best arbitrators and practitioners in arbitration.

Mr. Christopher David Easton F.R.I.C.S. C Build E is a Chartered Building Surveyor and Chartered Building Engineer with considerable experience in construction disputes. He is now a Consultant to his firm of Easton Bevins who employ over 20 Chartered Building Surveyors, Architects and Engineers. He leads the litigation team and undertakes the role of the Expert in all of the Courts in the UK including Adjudications. He is experienced in multi-level construction disputes advising on defects, compliance and professional liability. He regularly appears as a Single Joint Expert in both County Court and High Court and also acts for a number of national developers in resolving their domestic disputes.
He is a Governor of the Expert Witness Institute and was until recently, an External Examiner at the University of the West of England in construction law. He sits on the Ministry of Justice Committee on Expert and concurrent evidence (hot tubbing) and is a founding Governor of EWI Singapore. He is registered with the RICS Expert Witness Registration Scheme and has just been revalidated.
He has for the last 15 years had business interests in Malaysia and advises regularly on construction disputes and adjudications in the region.

Mr. John Gibson was at sea for twenty years before joining the Brookes Bell in 1996. He is a Chartered Engineer, with a Master’s degree, and since 2001 John has been a partner at Brookes Bell. An expert in his field, John uses his extensive consultancy and investigative experience to provide comprehensive assessments of marine and offshore casualties and disputes. The type of investigations John conducts are as diverse as they are thorough. As a member of the Institution of Fire Engineers John also reports on fatal and non-fatal fires. John has provided technical evidence for court proceedings and arbitration around the world and for the last 6 years he has been based in Singapore having set up the Brookes Bell office there. John is also a supporting member of the LMAA and a member of SCMA.

Dr. Thomas Walford has wide experience in Private Banking, Investment Management and Wealth Management. Thomas spent 19 years managing Private Banks and nearly thirty in the city managing or advising clients on investment and banking needs. Also wide experience of UK, Offshore and International relationships. Recent cases include working for financial institutions and clients in Interest Rate Swaps, Property Lending and adherence to Investment Objectives.
He has dealt with a multitude of client situations and resolved them to the satisfaction of the parties involved. Thomas is a governor of and is a certified expert by the Expert Witness Institute. In 2015 he was appointed on the jury of the European Expertise and Expert Institute (‘EEEI‘) as part of the European Guide to Legal Expertise (‘EGLE’) project. He is accredited by: the UK Register of Expert Witnesses, Expert Witness Institute, Academy of Experts, CEDR, also a member of the Chartered Institute of Arbitrators. Court Cross Examination a speciality, as is advising on pre-litigation decisions on a Particulars of Claim.
